Secondly, financing is part of the due dilligence. Here if you can’t get financing you dont close, but it depends on your due dilligence period as to when you back out if you get your deposit back.

Had similar when a Purchaser or a seller dies. The estate is bound to complete then re-sell.

Sales are in USD or Pesos. Beside Canada it is much better.

The estate was obligated to complete the purchase, but the lender cancelled the mortgage approval, so it was impossible for the estate to complete the purchase. I negotiated for the deal to be cancelled, with the sellers keeping the $40,000 deposit. I felt sorry for the estate beneficiaries, but in looking at this case, I feel much better! (The property is still on the market.)
